The terms for using ScaleX.

These terms govern a merchant's use of ScaleX, an AI agent that automates order confirmation, address verification, and risk flagging over WhatsApp on the merchant's behalf. By creating a ScaleX account, you agree to them.

1. The service

ScaleX connects to a merchant's WhatsApp Business number and, optionally, their online store or carrier accounts, and runs an AI agent that confirms buyer orders, verifies delivery addresses, and flags orders that need the merchant's own review — either because a buyer has a flagged history, or because information is missing.

2. Eligibility and your account

You must be a legitimate business and provide accurate information when signing up, including your store name and WhatsApp number. You're responsible for keeping your account credentials secure and for activity that happens under your account.

3. Your responsibilities as a merchant

• Provide accurate product, pricing, and policy information for the agent to draw on — ScaleX only answers buyer questions from what you've told it, and hands off to you rather than guessing.
• Comply with WhatsApp's own Business Messaging Policy and Meta's Platform Terms, since ScaleX sends messages on your behalf as a Tech Provider — a violation on your account can affect your WhatsApp access.
• Only sell lawful products and comply with applicable consumer-protection and e-commerce law in the markets you operate in.
• Make the final call on any order ScaleX flags as high-risk or needing review — ScaleX flags, it never auto-declines a buyer on your behalf.

4. Fees and payment

ScaleX charges per confirmed order, at the rate shown in your dashboard for your region, paid from a prepaid wallet. Orders cancelled for unavailability before confirmation are not charged; orders that are confirmed and later refused or returned are charged, since the service was delivered. 5. AI agent — what it does and doesn't do

The agent's confirmations are grounded only in the information you provide; it does not invent delivery promises, refund terms, or pricing. ScaleX is not responsible for a buyer's own actions, for a delivery carrier's performance once an order is handed off, or for losses arising from information you provided that was inaccurate.

6. Suspension and termination

You may stop using ScaleX at any time. We may suspend or terminate an account that violates these terms, WhatsApp's own policies, or applicable law, or that we reasonably believe puts buyers or the ScaleX network at risk.

7. Disclaimers and limitation of liability

ScaleX is provided "as is." To the extent permitted by law, we disclaim warranties of any kind and are not liable for indirect or consequential damages arising from your use of the service. [JURISDICTION-SPECIFIC LIABILITY CAP — CONFIRM WITH COUNSEL]

8. Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles.

9. Changes to these terms

We may update these terms from time to time; continued use of ScaleX after a change means you accept it.
